Loans are not Toasters: The Problems with a Consumer Financial Protection Agency

Policymakers continue to propose policies and regulations intended to prevent another financial crisis of the magnitude recently experienced. One major proposal is to establish another federal agency: The Consumer Financial Protection Agency to protect consumers from "bad" loan and credit products, just as the Consumer Products Safety Commission protects consumers from faulty toasters. This Mercatus on Policy maintains that the underlying causes of the financial crisis are not related to consumer protection issues. Rather, consumers rationally responded to a set of incentives including federal policies and state anti-deficiency laws. Hence, the creation of a Consumer Financial Protection Agency is unwarranted.
