About This Event

During the past year, antitrust policy has been in a state of tension. Enforcers on both sides of the Atlantic are moving toward a more expansive regime filled with rules, regulations, and interventions. Courts, however, are holding firm to an antitrust policy centered on consumer welfare enhancement that has, by and large, held sway over the last four decades. In January 2022, at the inaugural Mercatus Center Antitrust Forum, Former FTC Chairman William Kovacic asked, “will it stick?” This year we will dive deeper into this question and try to determine whether the current state of antitrust policy is a temporary detour or a permanent course correction.

The 2nd annual Antitrust Forum: Policy in Transition will convene leaders from the antitrust community to discuss the state of antitrust enforcement policy, here and abroad, during the second year of the Biden administration. The forum will feature presentations by former and current leaders of the Federal Trade Commission and the Justice Department Antitrust Division. They will consider the legal and economic policy ramifications of major enforcement, legislative, and policy initiatives in the antitrust space during 2022 and beyond.

With so much activity in the world of antitrust, this event will present varying perspectives on critical and timely issues, including experts representing diverse political viewpoints who have contributed and will continue to contribute substantially to scholarship in this important area.
