A Public Choice Analysis of the Affordable Care Act's Interim Final Rules

Jerry Ellig’s slide presentation provides a summary of the main findings of his study with Christopher Conover, “Beware the Rush to Presumption.” The study looks at the 8 major interim final rules that were used to implement the 2010 Patient Protection and Affordable Care Act. They discovered that the rules contain top-driven, low-quality regulatory analysis that reads more like an attempt to justify decisions, rather than inform them.
